Crawford and Lewis v. V & J United Enterprises, LLC, et al.

On August 12, 2015, Samantha Crawford and William Lewis filed a putative class action Complaint against V & J United Enterprises, LLC, V & J National Enterprises, LLC and Pizza Hut of America, LLC in the U.S. District Court for the Northern District of New York, which is assigned case number 5:15-cv-986.
Scope of putative class and collective action:
The lawsuit is brought on behalf of all individuals whom Defendants employ or have employed in the “pizza delivery driver” position at any time since August 12, 2009.
Claims in the lawsuit:
The lawsuit focuses on the fixed delivery fee Defendants charge customers for pizza delivery. As alleged in the Complaint, customers reasonably believe that fee to be the driver’s gratuity when, in fact it is not. Defendants, instead, retain some or all-of-the fee. Plaintiffs therefore assert Defendants violated the New York Labor Law by unlawfully retaining these fees.
On August 12, 2015, Plaintiffs filed the Complaint.
