Your employer must pay you for these two things.

Hi, my name is Doug Lipsky. I am an employment lawyer.

The first thing your employer must pay you for is on call time.

Whether you must be paid depends on where the on call time occurs. If you are required to remain at work, your employer must pay you even if you are not actively doing anything.

If you are at your employer’s place of business and available to work, that time must be paid.

If you are at home, the situation can be different. If your employer places so many restrictions on your time that it is not really your personal time anymore, then it is considered the employer’s time and you must be paid for it.

The second thing your employer must pay you for is training.

There is an important distinction when it comes to training. If the training is required by the state or federal government and it occurs outside of normal work hours, the employer may not have to pay for it.

However, if the training is required by the employer, such as shadowing other employees or obtaining a certificate that the employer requires, then the employer must pay you even if the training happens outside of regular work hours.
