Jesse Jenkins et al v. Whitney Museum of American Art

On August 13, 2021, Plaintiffs Jesse Jenkins, Thom Quincy, and Carlos Jacobo filed a putative class action Complaint against Whitney Museum of American Art in New York County Supreme Court, which is assigned case number 157627/2021.

Scope of class action members:

The lawsuit is brought on behalf of all individuals whom Defendants employ or have employed as security guards since August 13, 2015.

Claims in the lawsuit:

The lawsuit alleges that Whitney Museum failed to pay security guards their hourly wage for all hours worked, specifically the time spent donning uniforms before the start of each scheduled shift, time spent assembling before each shift, time spent clearing the museum of patrons after the museum has closed, and time spent doffing uniforms at the end of each scheduled shift..
